Williams Kherkher Files Suit on Behalf of Sherman Bus Crash Victims
Houston (PRWEB) August 20, 2008 -- Houston personal injury law firm (http://www.williamskherkher.com) Williams Kherkher has filed suit on behalf of a man who was seriously injured in one of the deadliest Texas bus accidents in recent memory.
On August 8, 2008, the blowout of an illegally recapped tire caused a bus carrying 55 passengers from Houston, Texas to Carthage, Missouri to careen off U.S. Highway 75. The crash, which occurred near Sherman, TX, killed 17 people and severely injured dozens more.
Williams Kherkher is seeking the recovery of actual and exemplary damages on behalf of plaintiff Tuan Tran and his wife, Lisa Tran. According to the petition, filed in Harris County District Court, Mr. Tran sustained severe and permanent physical injuries as a result of the Sherman bus crash, including intracranial hemorrhages and fractures of his hip and neck.
The couple is also suing for past and future medical expenses, disfigurement, physical impairment, loss of services, loss of consortium, and loss of life's enjoyment.
The Defendants
The bus accident lawsuit (http://www.williamskherkher.com/sherman_bus_accident.aspx), Cause No. 2008-48693 in Harris County District Court, names bus driver Barrett Wayne Broussard; bus manufacturer Motor Coach Industries, Inc.; bus companies Angel Tours, Inc., Iguala Busmex, Inc., and Iguala Bus Ltd. Co.; and owner Angel De La Torre as defendants.
According to the petition, the defendants were negligent in causing both the crash itself and the injuries which Mr. Tran sustained as a result.
The plaintiffs allege that Iguala Busmex, Inc., which operated in conjunction with Angel Tours, Inc. and Iguala Bus Ltd. Co., failed to adequately maintain and/or repair the bus. The allegations echo the sentiments of federal investigators, who called Iguala Busmex's maintenance procedures "grossly negligent."
In addition, the lawsuit claims that the bus company failed to train driver Barrett Wayne Broussard and should have known that he was unfit to operate the vehicle. Broussard, who was also injured in the crash, has been previously convicted of DWI, twice cited for speeding, and penalized for violating hours-of-service and medical certification regulations.
The suit also seeks to hold Motor Coach Industries liable for failing to provide adequate "occupant restraint and protection systems," which, the filing claims, were "economically and technologically feasible." In 2005, Motor Coach Industries was hit with a $17.5 million judgment for failing to install key safety features. In that case, the lack of seat belts and laminated windows caused 14 passengers to be thrown out of the windows during a collision in 2003, resulting in 5 deaths.
On August 8, 2008, there were no seat belts on the bus.
