Florida Lawyer Files Lawsuit Challenging Photo-Enforced Red Light Program

Hallandale, FL (PRWEB) February 24, 2009 -- Bret Lusskin, Esq., founder of The Ticket Cricket (www.TheTicketCricket.com), a South Florida traffic ticket defense law firm, has filed a lawsuit against the City of Aventura, challenging the validity of the city's photo-enforced red light violation program (case no. 09-12736CA09, Miami-Dade Circuit Court, 11th judicial circuit).

On October 18, 2007, the City of Aventura in South Florida enacted a law allowing the city to deploy unmanned, automated cameras at several major intersections to photograph vehicles that run red lights. The city mails a traffic citation to the owner of any vehicle seen violating a red light. The fines range from $125.00 up to $500.00 per violation.

Mr. Lusskin filed the lawsuit against Aventura on behalf of a client who was issued two citations by the city. The lawsuit alleges that the city's red light program is invalid as it conflicts with state law on the subject. According to Mr. Lusskin, "Aventura's red light program is totally illegal, and quite unfair. The fines are significantly more severe than those authorized by law and the program holds vehicle owners responsible even if they weren't the ones driving." On the issue of Aventura's decision to pass the law, Mr. Lusskin remarked, "They should have known better. In 2005, the Florida Attorney General wrote a letter publicly advising that programs like this would be illegal. They did it anyway."

Mr. Lusskin is awaiting a response by the city of Aventura. Depending on the results of this lawsuit, Mr. Lusskin says, he might file similar charges against other cities in the state of Florida.
